1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Otter Hive ("we," "us," or "our") governing your access to and use of the Otter Hive website, platform, and related services (collectively, the "Service").

By accessing or using the Service — including by creating an account, subscribing to a plan, or simply browsing the site — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

You must be at least 18 years of age to use the Service. By using it, you represent and warrant that you meet this requirement.

                    These Terms were last updated on April 21, 2026. We will notify registered users of any material changes by email. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms.
                

2. Description of the Service

Otter Hive is an AI-powered market intelligence platform that generates algorithmic predictions and analysis across financial asset classes including publicly traded equities, cryptocurrency, precious metals, energy commodities, and agricultural commodities.

Access to the full feature set of the Service requires an active paid subscription (Monthly or Yearly). Pricing, plan features, and billing terms are described on the Pricing page and may be updated from time to time with notice to subscribers.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice to active subscribers where practicable.

3. Licence & Permitted Use

3.1 Personal, Non-Commercial Licence

Subject to your compliance with these Terms and maintenance of an active subscription, Otter Hive grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your own personal, non-commercial, informational purposes.

                    What this means in plain terms: You can log in, view predictions, set alerts, and use the dashboard to inform your own personal investment decisions. You cannot sell, share, republish, or build something else with our content.
                

3.2 What You Are Permitted to Do

View and read AI predictions, signals, and analysis on your personal account dashboard

Use prediction outputs to inform your own personal investment decisions

Set personal alerts and customise your dashboard preferences

Download or print content solely for your own personal, offline reference

Share occasional limited excerpts informally (e.g., screenshot to a friend) provided no commercial advantage is gained

Access the Service from any personal device using your own credentials

4. Prohibited Uses

The following are strictly prohibited. Violation of any prohibition may result in immediate termination of your account without refund, and may expose you to civil or criminal liability.

4.1 Commercial Exploitation

This is our most important restriction. The AI predictions, signals, data, analysis, and any other content generated or provided by Otter Hive are licensed for personal use only. Any commercial use, redistribution, or incorporation into other products is strictly prohibited without our prior written consent.

Reselling or redistributing Otter Hive predictions, signals, or content to any third party, whether for payment or free of charge

Building or training another application, product, website, or AI/ML model using Otter Hive content or predictions

Publishing or broadcasting Otter Hive predictions on social media, newsletters, YouTube, podcasts, or any public channel as if they were your own work

Incorporating our data or predictions into any commercial trading tool, signal service, advisory service, or financial product

Charging others for access to our content, directly or as part of a bundled commercial offering

White-labelling or rebranding Otter Hive content or functionality under another name or brand

4.2 Account & Access Abuse

Sharing your account credentials with any other person, or allowing multiple individuals to use a single subscription

Scraping, crawling, or otherwise automatically extracting data from the Service using bots, scripts, or automated tools

Attempting to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or source code

Creating multiple accounts to circumvent subscription requirements or feature limits

4.3 General Prohibited Conduct

Using the Service for any unlawful purpose or in violation of any applicable law or regulation.
Attempting to gain unauthorised access to any part of the Service, its servers, or its databases.
Introducing malware, viruses, or other harmful code into the Service.
Interfering with or disrupting the integrity or performance of the Service.
Impersonating any person or entity, or misrepresenting your identity or affiliation.
Facilitating market manipulation or any fraudulent trading scheme.

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the AI prediction engine, algorithms, models, software, website design, text, graphics, logos, icons, data compilations, and the Otter Hive name and brand — are the exclusive intellectual property of Otter Hive and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

The licence granted to you under Section 3 does not constitute a transfer of ownership. You acquire no proprietary rights in any content accessed through the Service. All rights not expressly granted herein are reserved by Otter Hive.

6. No Financial Advice

Otter Hive does not provide financial advice, investment advice, or trading recommendations. All predictions, signals, analysis, and other content are provided for informational and research purposes only and should not be construed as advice to buy, sell, or hold any financial instrument.

Past prediction accuracy does not guarantee future results. All investing and trading involves significant risk, including the possible loss of the entire amount invested. You are solely responsible for your own investment and trading decisions.

Before making any financial decision, you should consult with a qualified, licensed financial adviser who can assess your individual circumstances, financial goals, and risk tolerance.

Otter Hive is not a registered investment adviser, broker-dealer, financial planner, or fiduciary under any applicable law or regulation.

7. Subscriptions & Billing

7.1 Subscription Plans

Access to the Service requires an active paid subscription. Current plan options, features, and pricing are listed on our Pricing page. We reserve the right to change pricing with at least 30 days' written notice to existing subscribers.

7.2 Billing & Renewal

Monthly subscriptions are billed on a rolling 30-day cycle. Annual subscriptions are billed once per year. Unless you cancel before the renewal date, your subscription will automatically renew at the then-current rate. You will receive a renewal reminder email at least 7 days before any annual renewal.

7.3 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain full access until that date. We do not provide pro-rated refunds for partial billing periods, except as required by applicable law.

7.4 Refunds

Monthly subscriptions: no refunds for partially used months. Annual subscriptions: a full refund is available within 30 days of initial purchase. After 30 days, annual subscriptions are non-refundable. Refund requests must be submitted to [email protected].

7.5 Payment Processing

All payments are processed by third-party payment processors. By subscribing, you authorise the relevant processor to charge the payment method on file at each renewal. Otter Hive does not store card details — see our Privacy Policy for full details.

8. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

Keep your password secure and not disclose it to any third party.
Notify us immediately at [email protected] if you suspect unauthorised access to or use of your account.
Ensure that all registration information you provide is accurate and kept up to date.

Otter Hive is not liable for any loss or damage arising from your failure to comply with these obligations.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not warrant the accuracy, completeness, or reliability of any prediction, signal, or analysis generated by the Service. Market predictions are probabilistic by nature — they can and will be wrong.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OTTER HIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOST PROFITS, LOSS OF DATA, OR INVESTMENT LOSSES — ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless Otter Hive and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

Your breach of these Terms;
Your violation of any applicable law or regulation;
Your use or misuse of the Service;
Any trading or investment decision you make or refrain from making based on content from the Service; or
Any infringement of any third-party rights resulting from your use of the Service.

12. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a security risk to the Service or other users.

Upon termination, your licence to use the Service ceases immediately. Sections covering intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law shall survive termination.

You may terminate your account at any time by contacting [email protected] or using the account deletion feature in your dashboard.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Otter Hive is incorporated, without regard to its conflict of law provisions.

You agree that any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.

14. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, Disclaimer, and Cookie Policy, constitute the entire agreement between you and Otter Hive regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely.
